Terms and Conditions of Use

Applicability

The General Terms and Conditions of Use below apply to all offers and transactions of Como Restaurant Pty Ltd. By accepting an offer or making an order, the consumer expressly accepts the applicability of these General Terms and Conditions.

Prices and offers

All offers made by Como Restaurant are without obligation and Como Restaurant expressly reserves the right to change the prices of its products. All prices are indicated in the currency of Australian dollars (AUD), including GST. Prices are subject to change from time to time and may be exclusive of card processing fees or other automated deductions required by third party service providers at checkout. Where promotional prices apply, such prices are valid during the specified period while stocks last. No entitlement to these prices may be invoked before or after the specific period. Como Restaurant will not be held to any price indications that are clearly incorrect, for example as a result of obvious typesetting or printing errors. No rights may be derived from incorrect price information.

Cancellations

Como Restaurant is entitled to cancel or change the date of an event or other booking. Should this happen, Como Restaurant will attempt to provide a suitable solution in the alternative. If an event or other booking is cancelled or postponed, Como Restaurant will act reasonably to inform you as soon as possible. However, Como Restaurant does not guarantee it is possible to inform you timely of any change or cancellation of an event or other booking or be held responsible for refunds, compensations or for any resulting costs you may incur, for example for travel, accommodation and/or any other related goods or service. Prior to confirming your reservation, always check carefully that you have reserved the correct number of patrons. All purchases made whether online or in-store are final subject to any refund policy expressly applied by management.

Payments

All prices are GST inclusive. We accept payment via cash (in-store), Visa, Mastercard and American Express. You will not receive confirmation of your booking until your payment has been approved.

Other provisions

If one or more of the provisions in these Terms and Conditions of Use or any other agreement with Como Restaurant are in conflict with any of our statutory obligations, the provision in question will lapse and be replaced by the comparable stipulation admissible by law.

Otherwise, Como Restaurant is subject to the jurisdiction and laws of Queensland the Commonwealth of Australia. Any disputes arising directly or indirectly from these agreements will be exclusively settled by a court of relevant jurisdiction or by mediation between the parties.

We are required to comply with the Federal Privacy Act 1988 (Cth) and the Australian Privacy Principles, and therefore our privacy policy applies to any personal information we collect, use or disclose, including the personal information of our employees and contractors.

How and why we collect personal information

We collect personal information in order to provide various services to our customers. Personal data, meaning any data that relates to an identifiable person who can be directly or indirectly identified from that data, may be collected through use of this website. Your information may be collected when you make a booking, when you visit our restaurant, when you make an enquiry and when you sign up to promotions. With consent, we may also use personal information for related purposes including providing clients with updates on our products and services that we offer, including updates on our seasonal and special events and promotions.

How we use and disclose personal information

We do not use or disclose personal information for any purpose that is unrelated to the services we provide and that you would not reasonably expect for us to provide our bespoke customer experience. We have a duty to maintain the confidentiality of our clients’ affairs, including personal information. Our duty of confidentiality to our clients applies, except where disclosure of personal information is consented to by the client or is compelled by law.

Customer personal information may be disclosed to approved third parties who are also required to comply with the Australian Privacy Principles.

We endeavour to protect any personal information that we hold from misuse and/or loss, and to protect it from unauthorised access, modification and/or disclosure.
